If I come up with a rapper name that sounds like a name that is already trademarked (I didn't know it was trademarked until I just looked it up), but it is spelled differently, will I legally be able the use it?

BTW the person who had the name is already dead and they have nothing to do with the music industry. So I figure it shouldn't confuse people or interfere with the courts because ...

I want to make tailor made costumes/closplay outfits for comic conventions.  I have just been getting my feet wet with my mask reproductions.  My only concern of course is the potential to violate existing trademarks, and to be honest I am not sure of the legalities of doing full blown un licensed costume reproductions. 

What steps can I do to summit my idea...I don't need an attorney to do it right? is it free? what other information can I use? thank you for any info? Also, it is more of something other manufacturers could use on their products, so would that just be a patent or trademark?
