Question about false imprisonment?

Postby ealahweemah72 » Thu Mar 31, 2011 9:34 am

Okay, here's a hypothetical situation:

Person A willingly goes to Person B's house, so no kidnapping. Person B keeps Person A locked in their basement for, I don't know, several months against their will. Person B does not physically harm Person A, or neglect their needs. Person B eventually lets Person A leave. Is false imprisonment the only crime Person B committed?

Question about false imprisonment?

There could also be an "aggravated assault" in there, depending upon how B was being held.

Not only that, there are civil damages for false imprisonment, interference in relations, intentional infliction of emotional distress, to name a few to start.

Oh, and it is also "kidnapping", of course: "Whoever, without lawful authority, forcibly or secretly confines or imprisons another person within this commonwealth against his will," shall be imprisoned for not more than ten years... MGL 265 s 26, "Kidnapping", Massachusetts laws, as an example.
