Question for attorney re: class action lawsuit?

Postby dalon » Fri Apr 01, 2011 7:32 pm

I received a notice in the mail regarding a class action law suit being filed in a California court against a company I do business with.
(I am in Texas)
The notice says that if I do NOT want to participate in the lawsuit, I have to send a letter by mail or fax to the attorneys. It must be worded just right or they will throw it out.

Now to my question. Why in the heck do I have to go to the trouble of writing this law firm and paying for stamps and envelope, making a copy for my records, wasting MY valuable time, when I have never had a complaint with this company.
If I don't send this in, I may be blocked from taking action on my own should I have a problem.
I feel that the people who want to participate should be the ones inconvenienced with this bull.
Are these kind of notices illegal and if not, do you think they should be?

Question for attorney re: class action lawsuit?

That's the way the legal system works. Don't worry, your part of the class action suit will result in a few dollars, more or less. It's the attorneys who will reap the benefits of the class action suit. Good Lord! They suffered the most from this company's indiscretions.

If you want to be part of the class action, you do nothing. If you want to pursue your own case, you'll have to separate yourself from the class action suit via specific request.

If you do not "opt out" then you will be bound by whatever decision they reach, and blocked from taking action on you own if your cause of action is similar or related to the cause of action for the class action.
It is justified by the courts for many reasons including judicial efficiency - they don't want to hear thousands of separate cases - as the courts resources are limited
Yes they are legal, and my & your opinion doesn't really count.

You should probably consult with a lawyer. When I had a legal question, I went to quicklegalanswer.com. It was fast and very cheap. I got the info very quickly. Hope that helped!!

If you have no complaints with the company then you don't have to do anything.
