Service animal laws for CA.?

Postby shipley » Thu Aug 02, 2012 7:20 pm

I reside in California and my landlord has stated "guest's cannot bring their dogs on to the rental property." My guest is disabled and has a registered, certified service dog which accompanies her everywhere. Landlord has threatened to evict me if the dog & guest return to visit me. I have a fenced yard to provide additional security, but still he denies them access. Can he legally get away with this? What can I do to protect my rights and the rights of my guest.

Service animal laws for CA.?

He cannot. That is 100% illegal; a service animal must be permitted to accompany their owner anywhere they go, and the location must let them in.

The guest should have a certificate, or a license that stats their dog is a service dog. Read the back of that and it should tell you the laws about being discriminated against for having a service dog. The landlord will either have to pay a fine, or he could possibly go to jail.

Show him that card and see what happens. He is breaking the law.

Service animal laws for CA.?

Let me guess.
this "service animal" is one of the bogus ones belonging to someone who isn't blind, but has a psych note saying it makes them feel good.

Their right to have service animal doesn't include you letting roam about the yard. See the legislation requiring you to allow a person to be accompanied by such animals, doesn't require anyone to allow them to do anything beyond directly serving the person. If the animal isn't being used, it isn't a service animal.
