Should I "opt-out" or move forward as a Class Member in a Class action lawsuit?

Postby tai38 » Sat Apr 09, 2011 5:28 am

I worked for a company for a few years in high school and recently received a settlement agreement from someone who sued them. The company settled for a certain amount of money that I am eligible to receive a portion of due to my employment.

The amount I am due is less than $100. Is it more beneficial to simply opt-out and leave the money on the table or to go ahead and receive the money?

I really don't want my name attached to a lawsuit. Will it be public knowledge I was part of the class members?

It obviously isn't worth your while to go after them on your own.

Leaving $100 on the table is a waste of $100.

Because it was a out of court settlement there is no reason to think that the list is going to be made public. And even if it were nobody ever reads those things.

it's almost always to your advantage to be included in the class action, don't opt out.
