Should I receive overtime compensation for time lost due to a personal injury law suit?

I was involved in a car wreck where I was not at fault and lost 6 mo. of work.During that time,our dept.worked 12hr. a day.7 days a week.I have documentation on a company letterhead,signed by my supervisor saying as much.Should I expect this amount to be inclided in my settlement.Thanks.

No. The overtime worked by other employees was probably because you were not available to work. If you had been there, there would not have been the need for so much overtime. Since overtime is variable and not guaranteed, it would not likely be considered in any settlement. Hope you are feeling better.

No you should not expect to receive overtime compensation for time lost due to a personal injury law suit. You were not able/available to work due to a personal injury and actually did not do any overtime. Working 12 hours per day 7 days a week for 6 months is not normal even if your supervisor signs off on it. You should not expect this amount to be included in your settlement.

You should expect to be compensated for your actual losses. so, if you would have made that much money during that time, you should get that much money, including the overtime.

The judge can reduce or increase the overall settlement if he is deciding what the settlement should be (you haven't settled with the insurance company).

no, you should not. you should expect to be compensated for 8 hour days, with no overtime- regardless of what was happening where you really work.

no, overtime is a temporary situation and can't be counted as regular earnings.

you didn't work it so no... if you're full time, expect 8 hours a day, 5 days a week.
