Should i Sue Target for the way i was fired?

Postby bercnan72 » Sat Dec 24, 2011 10:31 pm

I was fired from target yesterday. It was my fault but the way i was fired was completely tormenting. Basically to sum it up i was fired for "stealing" gift cards but i was really just finding gift cards other guests left behind but still its a form of theft which is fine and understandable. But I feel i could sue for entrapment & defamation of character for this: So as a Target employee I was a pretty good one as the standard employee goes. I was hardly late, rarely called out and would always take shifts, switch shifts and stay longer if asked. I even stayed passed my 90 days with an A+ having all check marks yes to me fulfilling my duties. So moving on to the day i got fired, 12-23-11, It started out like any other day a short shift 8-12 but in the hour of 11:00 i was asked by Kimberly, ASST. MANAGER if i wanted to stay an extra 2 hours which i agreed to and then proceeded to take a 45 min break. Once I came back from my break i worked until 12:34 exactly and was told from Cari, CASHIER that it was time for my last break, which i thought was odd since i just had my lunch but thought since two ppl had called out earlier that day they were trying to get all my breaks out of the way so i could work until the end of my shift. Then once i was done checking out all my guests I signed out, and proceeded to go on my own to the break room when then Tiffany,GSTL walked me to the door of the Team Member's only area saying "Kimberly wants to talk to you." and while walking there I immediatley felt in trouble saying "I feel like i'm in trouble" for it being so inconspicuous when Tiffany reassured with a simple "no". So with that I felt comfortable being led now by Kimberly to her office where then Erin, ASSET PROTECTION was already sitting on a chair with pen and paper in her hand. Once sat down, I was asked how i was doing that day, and talked to about my work effort and who helped me when i first got hired and who i've helped as well basically topics i've been talked to about before and then gift cards. How I sold gift cards what i did to help target further sales with gift cards. All of which i was proud and happy to explain. Then they said there was a problem with my guests gift cards saying they can track my activities with registers with my number and also track my purchases with my discount card which made me believe i was in trouble for using giftcards i was finding. I believe i said "I hope my job's not in jeopardy." in which Kimberly made it clear "Well, your job is in jeopardy." Then She continued with questions of how i actually "stole" giftcards and how i did it, why i did it, what i bought with them being asked in a very nice calmly manner to be honest and they felt i wasn't telling them something. Reminding me again they had my transaction history in their hands. Then they tried to figure out if others were involved even when i said it was just me i felt like i had to explain why it was just me probably perpetrating myself in the process. They didn't understand why i would find giftcards and not turn them in. Which then i had to explain my personal life and how presently my boyfriend didn't have a job and i only used the gift cards towards food which they had proof for with their copies of my receipts. Then Kimberly said "I feeling like your not telling us something." Which confused me because I came clean with the gift card things what else did i do? Then she said "we just want to know if you've done any other activity like steal merchandise or cash or anything else with the gift cards." which then made me think of how i have cashed out gift cards and once i told them they still wouldn't let go of the fact that i stole gift cards in a way i made it sound not bad. They were judging me making statements sounding lost finally hearing from Erin, "I just don't understand why you'd think the camera wouldn't see you or that you couldn't get them to the guest." Once I told her i didn't have an answer for that other than i hoped the camera wouldn't see me. Then Kimberly continued saying "using gift cards that are meant for guest and using them" was a form a theft and could result in being prosecuted and being terminating. Then i knew i was in serious trouble when i teared up saying "sorry." in which Kimberly replied "that's ok." Then once i shed tears Kimberly looked at Erin asking if she had other questions where Erin said "I'm just confused about the cameras not seeing you, why did you think the cameras couldn't see you." i told her i didn't have a good answer for that other than i hoped i didn't get caught which sealed my fate pretty much where Kimberly told me i was terminated and i needed to sign papers i got fired. i got my final pay and was told to return my vest, name tag and dis

Should i Sue Target for the way i was fired?

You should DEFINITELY sue, and (to save money and all the hassle of finding a lawyer to take the case) you should represent yourself...

The Court could use a good laugh!

You were fired. You have no valid law suit.

You are a thief, so being fired for theft isn't defamation of character.

no, you can't sue them. they did not defame you or fire you improperly or entrap you. you chose to use peoples gift cards instead of throwing them out or telling the guests there was still money left on them.
they fired you in private. it's not like they fired you over the p a system for everyone to hear. your lucky they didn't file fraud charges against you and have you arrested.

I do not even have to read all this. You work in an at will state so that means they can fire you at any time and for any or no reason. From what I did read they had a reason. And you have no case to sue for.

Sounds like they were the professionals, certainly not you, you thief.

Yeah, go out and spend $10K so you can lose your butt in court because you were wrong and they are right.

I didn't read 99% of that rant, but I can answer your question. You can sue, but the chances of winning are slim to none. Forget it, and move on.

Sue for what?

They did nothing wrong here.

You have no cause to sue.

You are a thief who got caught and Target treated you kindly.

To your edit: you have no lawsuit.

You aren't the victim of entrapment. You are lucky they aren't going to the police with this. Cops do this all the time entice you into a confession so they can then charge you with your confession. What target did isn't illegal.

You are a theif. If you don't want to be treated as such, don't steal. Crazy idea, huh?

You have no damages to sue for.

All you are is another self entitled greedy theif who thinks the world owes you. You steal fom innocent people, now you want money for getting fired because it is unfair they called you out for getting caught. You are a loser.
