as a general rule employers do ususally do reference or background checks until an offer of employment has been, there are 30 million people out of work in the US so good jobs are hard to come by.
in all states it is not illegal to give truthful references good or bad and in some states if the employer believes it to be true that is legal as well.

Do not worry about your former employer. People will see through you during interviews whether you have the skills they need from someone applying for a job.

Why I think you should do is to forget about the past. Set your five and ten year goals then ask yourself how you can achieve them. It is very important that you already have something concrete in mind before you draft your next application letter and resume,

Move on. You will eventually get the job you want if you embrace the life that you desire.
