So today i recieved a notice from Ga dept of labor that my babysitter has filed for unemployment insurance and?

listed me as her employer , so now I have all this paperwork to fill out, register for an employer number. and pay her umemployment insurance. My question is is this for real? I mean we paid her around 3000 for the year, i noticed she put down her employment from 4/11 to 12/11 , even though she actually started in march not april.
I noticed if I state she started in april she qualifies for it, If I can prove she started in march can I fight it? And if i cant how much do I have to pay? I was thought it was .027 of the 3000. My mother in law thinks it is actually .027 , which is it more likely? And what steps do i need to take to protect myself.
Ps this started because my wife claimed the childcare as a deduction in her taxes and now the babysitter istrying to get back for reporting the claim.
pps The babysitter no longer works for us because I got laid off myself. and could no longer afford her

If you want legal advice, talk to a lawyer... Or in this case, an accountant.

Her starting date would make no difference in the claim. Eligibility goes by the highest-grossing quarter of the previous year.

The amount of unemployment benefits she receives does not come from you; you just have to take out an unemployment insurance policy and pay for that. The cost of that would depend on the company you choose.

She would have to qualify as an employee according to the IRS definition, which I assume Georgia would be the same as or similar to. http://www.irs.gov/businesses/small/article/0,,id=99921,00.html

If you paid her more than $1,500 during the year you owe federal and state employment taxes. The federal tax is reported on Form 1040 Schedule H (as in Household). The state will have similar forms. When she started isn't very important. What she earned is and you failed to report it.

I believe that the amount is 2.7%, or around $81

if you did not deduct taxes or paid them as an employer you can call her a contractor and issue a 1099 so she is responsible for all taxes and no unemployment
