Statute Of Limitation On Credit Card Charge?

Postby Rowen » Wed Jun 25, 2014 4:00 pm

I made a purchase at a furniture store over a year ago, using their store credit card. They mistakenly refunded the amount after some confusion with delivery, and I never alerted them to their mistake(I know, I know). Now, over a year later and after I've closed the card, they have somehow realized their mistake and charged me for the whole amount. Is there a statute of limitations for this, or can a business charge for a purchase made over a year ago on a closed credit card?

You owe the money. They can prove it. They've minimally got 7 years, and can they can extend that. And, they can sue you and include their legal fees and whatever penalties they're entitled to by law.   gabrielhusseinnova 10 months ago

You'd need a court case and a judge to decide that interpretation of their rules vs. the law. Partly in your favor is their taking a year to do anything. Partly in their favor is your never telling them(there's no such thing as "free money.") However, the store can continue dinging your credit until either the judge tells them to stop or you pay them. How much are you willing to put up with? Are you a gambling man?   danielpauldavis 10 months ago
