I got caught shoplifting at walmart last year for 62.00 paid a fine to the court and to walmart

this year i had a cashier same store that i would go to and match flyers from different stores even from new jersey

to make along story short they said i having items underung by the cashier i would frequently go to her and later on she did not even ask for the flyers so now here i am being charged with a 3rd grad felony for undering i am suppose to have a preliminary hearing next week i really did have the flyers i don't get it they said it came to apx 5 thousand dollars but if they don't have the flyers just copies the receipts how do they know that i did not have a flyer to match the items?how can they prove it? I don't have theflyers now but i did have them at the time she didn't ask for them later on.

From her statement to the police she needed a friend how could i be a friend when i didn't know her last name or where she lived. I did ask people i met a walmart is she was there i did hug her on her birthday andgive a gift but i also gave xmas gifts to the greeter at the door and to 3 customer service managers!I don't get this what can happen to me i can't prove about the flyers i don't have them anymore!

What can i do and what would be the punishment if found quilty?

Susan-

You appear to have several things going against you. The first of which, you have a prior offense at that same Walmart. Secondly, it would appear that the cashier is cooperating against you and the fact that she is apparently making statements "against penal interest" will weigh heavily with a judge in determining who is telling the truth. Lastly, we will surmise that Walmart management will have both "barcode" scan evidence(or lack thereof) from the cashier's register as well as store surveillance video footage to support their allegations against you. In sum, you have a problem.

We would suggest you discuss this in detail with an attorney and see if another possible plea to a misdemeanor is on the table.
