UK Immigration Question?

Hello,

I am an American citizen who overstayed a UK Tier 4 Student visa by two weeks (unintentionally, I was given information that students had one month after our course ended to leave, however, this was not the case for me as I was only there on a five month study abroad).

I left the UK in late July 2011 to do summer traveling in Asia, and at this point, I had overstayed my visa by two weeks. I re entered the UK at the end of August 2011 to catch my connecting flight back home to the US which left the following day.

I was detained for 4 hours, and asked many questions about my overstay. Since I had adequate support in the UK I suppose, and a booked return flight home leaving in one day, I was given entry and allowed to remain for one week in order to catch my flight home. The officer said he was making a full report but that he advised I leave within the time frame he allotted me as he knew I would like to come back one day. I did leave the UK promptly and have not been back for nearly a year.

I have now been accepted onto a post graduate course at a University of London school. I have all my points lined up for my Tier 4 point based system: I have an offer of admission from the school, and adequate financial support for a full year of my course.

I have never been in trouble with the law or see any other reason why I may be not issued this new student visa, apart from my issue before with the overstay.

I have been told that since I have never been refused entry to the UK, and was granted entry on this particular overstay occasion despite everything, that I should be okay for my new student visa.

Can anyone advise if this is correct? Thank you.

Yes this is correct. Over stays of less than 28 days do not incur any penalty although you are going to be flagged on each entry, so make sure that you have all your visa paperwork with you when you come back and resign yourself to an inevitable interview.
