UK Law Immigration question....?

suppose there is an illegal couple living in the UK they are not rightfully allowed to stay in the UK. but they have had a child who was born in the UK. they have applied to the UK border agency to gain the right to live in the UK. but while he was working illegally here the husband the UK border agency did a raid in organisation where he was illegally working, he told them that he has a case already submitted, so they let him go...

are they able to gain rightful stay here in the United Kingdom if so on what grounds?

While they have an application with the Home Office they are unlikely to be removed until a decisiopn is made. However, if he is caught working again, there is every likelihood that he will be detained until removal.

They don't have any grounds to live in the UK. The child was only born in the UK. It cannot have any claim to citizenship on that basis alone. Their application is only a delaying tactic and a waste of taxpayers money.

I would suggest your friend seek advice from a solicitor.

What grounds do you possibly think there are for them to stay? What grounds were they using to apply to stay?

The UK does not have birthright citizenship, the child has no claim to citizenship.

There is a law where someone living illegally in the UK for 14 years can make a claim to stay but they MUST have stayed under the radar during that time (no arrests, not picked up for being in the country illegally etc) & they have to be able to prove they've been in the country for 14 years

I do not know the laws on UK, but in USA if he are in detention for working illegally, most likely he will loose all the rights to complete his residence. Good luck...!

not enough information. You fail to mention what country they are from. What sort of claim/case they submitted/applied for.
