1) Our annoying neighbour put up a high wooden fence some years ago, between our garden and his. Now he is demanding that he be allowed to enter OUR property so he can paint his fence in stinking creosote. He says things like the fence cost him £300 to build but no one asked him to build the thing, he could have simply put up a mesh fence. I'm prepared to let him in maybe in autumn when everything has died down, but he won't wait.
2) He also seems to think he has the right to dictate what we plant on our side of the fence. I do make sure anything I do plant or build does not touch his precious fence. I mean ok I would not plant a 50ft high Leylandii or anything thing like that, but he doesn't want any trellises withing a certain distance of his fence etc.
I have spent a lot of time and money making this part of the garden nice with bedding plants, shrubs etc. Its the middle of July the weather is nice but until now we have been unable to sit in our garden for the last 2 months due to the wettest summer on record. If he creosotes his fence on our side we won't be able to enjoy the garden for the obnoxious smell, now to mention that we have a fruit tree next to the fence and the fruit will be inedible. Last time there was creosote splashed all over the place and he cut down one of our shrubs because it was too close to his fence!
1) Does our neighbour have any right to be on our property to paint his fence?
2) Does he have any right to dictate what we plant within reason on our side of the fence?
