On 4th July 1776 the Continental Congress in America adopted the Declaration of Independence. If the immigration chronology of USA right from that time is examined, one would arrive at a conclusion that disregarding Ravenstein's Laws of Migration, the Neo Classical Theory of Migration, Segmented or Dual Labor Market Theory, The World-System theory, The Migration Networks Theory and all other theories, laws and rules of migration, USA has adopted the Theory of Legislative Restraint in the matter of Migration.
It may be a temporary visit for a day or a month. It may be a visit which may last till the visitor completes the purpose for which he has entered USA viz. study, work as a seasonal or a speciality worker, or it may be an entry to stay in USA, for ever your entry into USA is controlled by legislation. And USA Government has enacted laws as per its needs.
The writer has recently submitted a Thesis to the University of Mumbai for the Ph.D. Degree in law on the subject of “Effect of USA Immigration Laws on the Migratory Trends of Indians” and has in his “Thesis propounded the Theory of Legislative Restraint”.
The writer defines his theory of Legislative Restraint as “Migration to the USA, for whatever reasons, is controlled by the USA Government as per its needs, by it laws and rules and regulations which are enacted, amended, modified, altered and/or rescinded as the USA Government wants. In doing so, it disregards all other theories, rules and laws of migration including “Push” factors of outsiders and its own “Pull” factors”.
USA Government does not take into consideration any factors affecting immigration save and accept its own needs and desires. If there is a famine in another country and a million people want to migrate to USA to avoid starvation, USA will not allow all of them to migrate into USA. USA Government will consider its own needs for immigrants, will consider what type of people are who desire to migrate to USA, will consider whether they are whites or non-whites, educated or illiterate, skilled or non-skilled, industrious or lazy, rich or poor, religious fanatics or liberals, what effect it will cause upon USA people and economy, what will happen to the image which USA carries in the minds of people of the world if they are allowed or not allowed. Then USA Government will take a calculated decision and allow those many people whom they feel should be allowed into USA. If there is a drought in a country and half a million people want to migrate to USA to avoid hunger, USA Government will not take all of them into USA as refugees. It will only admit that many people as it feels USA needs. Only self interest is considered in allowing migration and those who are not needed would be Legislatively Restrained.
