What are the Labor laws for New York State?

Postby dalon » Tue Dec 13, 2011 6:36 pm

Im 33 weeks pregnant, I havent had a doctors appointment in 7 weeks. One was canceled due to the fact i caught the flu and the other was canceled because my boss scheduled me during my doctors appointment for the 5th time, even though I requested off more than 2 weeks in advance. Well I made a doctors appointment again it is at 2:45 and he scheduled me 10:30-5. I requested it off a week before hand and had this conversation with him, ME: "I know its last minute but i havent had a doctors appointment in weeks, so I can only work 9-2 on Monday"(while writing it on the request off calendar). BOSS: "thats fine i Havent written the schedule for next week yet". Now Im scheduled to work He wont let me have off for it and I cant find anyone to cover the shift for me. Can he legally do this to me? I need to go to the doctors. I have a high-risk pregnancy. Ive almost lost my baby twice. I just need to know what I should do?

Check here for starters: http://www.lectlaw.com/files/emp31.htm

I hate to suggest this, but your boss might be trying to force you to quit because it's illegal to fire you due to your pregnancy.

Check your company's employee manual.

If you are having a high-risk pregnancy, you might be eligible for disability until you deliver.
