Why is the insurance saying the accident was my fault?

Postby freedom97 » Sun Feb 26, 2012 9:10 am

Last week I was on my way home from work and the car infront of me starts to stop cuz the light turned yellow so I start to stop to. The truck behind me was going about 45 ad hits my car at an angle cuz he was changing lanes causing my car to go under the suv infront of me totaling my car and get this the guy who hit me ran! But thank god witnesses got his license plate. So when the insurance adjuster looked at my car he said due to the damage in the front of my car (the driver side of the front part of my car all pushed up to my window)doesn't match the damage in the back cuz the back wasn't messed up as bad as my front. The accident is my fault! How is that possible when I was obaying the traffic laws and stopping at a yellow light and he hits my causing my car to hit the car in front of me. Btw there was like 1ft skid marks from the truck ad about 10 feet of skid marks from my car. The accident made my air bag deploy and broke my seat belt and completely killed my car it wouldn't start.

sounds like you were all being stupid.

insurance only applies what the police report says. the cop says you were at fault. if your damage is significantly worse in the front, that implies you hit the car harder in front of you, than you were hit from behind, and thus, you are at fault for the damage at the front.
