Workers comp in Texas?

I was diagnosed as having a "stress related mini stroke" and was told not to return to work until my headaches were better and I could move around better. I have a VERY stressful job and believe this contributed to the mini stroke, and I want to file workers compensation.. Do you think I have a case?

Find an attorney and ask them. Yes this will probably cost some money (maybe about $50 or so), but you're going to be better off with a real consultation rather than just asking on the internet.

File the claim. You never know what will happen. If you doctor says it's caused by work than why not protect yourself?

The only problem I see is that you might have pre-existing injuries. For instance, high blood pressure might run in your family. That is a contributing cause to a stroke.

If you file and the workers comp denies than you'll be provided options on what to do. Appeal or just drop the case. You'll have to prove that your job is really stressful.

Also some states don't treat stress well. If your stressed due to a disciplinary reason, than I see the file being denied, but again, it's up to you to prove that stress caused your stroke.

This will be a tough one. The workers comp carrier is sure to try and prove a preexisting condition. But you have nothing to loose by making the claim.

you could try, but in most states they do not accept "stress" complaints unless you can prove your job is much more stressful than everyone else in that job.
