About workers compensation?

Postby calvert » Sat Jun 16, 2012 8:01 pm

so i had a previous condition that involved my back from a couple years ago. recently at work my back was getting tight but no pain, and i got a doctors note saying no heavy lifting for a month so i wouldnt hurt anything in my back again. at work i was lifting something over the lbs i was aloud bc my boss told me and i felt a burning sensation and a pop in my back, and now there is pain and i cant do anything bc of the pain.

is that workers comp since my previous condition was not involved bc i have notes saying i was fine to do work when i got hired.

Might be, however you are partly to blame as you lifted something you knew you should not have. You should have reminded your boss about your limitations.

If you were hurt at work, it is a worker's compensation case not matter what your previous doctor said, or what you were lifting. They could conceivably fire you as unfit for work after the accident, but it does not affect the claim.

You had this prior to be hired.
You should have known your limitations. No worker's comp here.
