Ca Unfit Mom/ex Girlfriend Of 13+ Years

Good Day, I have an unstable ex-girlfriend of my boyfriend that has given her son up to us to only take him back shortly after.  The child is 14 & is in my opinion in a very emotionally/unstable relationship with the mom. She receives a good amount of child support & every so often she gets very erratic & starts verbally abusing the child as well as harassing my boyfriend the grandmother & myself.  They where never married, she has not worked for the past year or two & is collecting disability & her $1500 to now $1000 child support which my boyfriend just gives her, not ordered by the court.  Which she is now threatening to drag us through the mud & she is going to try & get more money+ alimony.  We live in California what can you advise we do.  Please the child calls us very unhappy & very emotional, she takes him late to school or to no school at all depending on what she has going on.  The mom uses as a tactic to keep him from visiting us to punish him or maybe us.

You could file a motion with the court seeking custody of the child. Ask the court to order a psychological evaluation to determine if she is fit to be the custodial parent. The court should consider the wishes of the 14 year old when they determine what is in the child's best interest.

Best if you can do this before she files for an upward modification of the support order, this will protect you from looking like you are doing it to retaliate.
