Can a settled workers compensation case be reopened?

My new physicians have suggested that I have my case reopened after reviewing my medical records. At the time I signed the settlement I was told that I could either except the settlement and get surgery or let the case go to arbitration which to take up to two years to settle at the time had a 7mm disc protrusion pressing on my spinal cord and compressing nerves in both legs I had lost control of my bladder at the time I felt I had no chose they told me the settlement was only for me to pay for the surgery and I had to use their doctor well I have had two back surgeries and now I am seeing a new doctor who says I still have a 5mm disc protrusion after two back surgeries in oct.09 21 and 28 there is a lot more to the story and I think it is worth looking in to. I am 26 years old is now disabled had to drop out of nursing school and no longer can work.

Workers' compensation laws differ from state to state.

If you have an attorney, discuss it with him. If not, GET ONE.

Make sure your attorney SPECIALIZES in applicant Workers' Compensation law. They cannot charge you for a consultation and any fees they receive are paid at the end out of your benefits, and only after an Order made by the Judge who decides the case.

Note - if you previously agreed to the settlement you described without having an attorney, that was a MAJOR MISTAKE. Workers' Compensation is an adversary system, and your employer's insurance company is in the business of MAKING MONEY. The will do anything and say anything (and so will the doctors that THEY EMPLOY) to coerce you to settle for far less than to what you are entitled.
