Can I cancel my timeshare agrement?

Postby tupac » Thu Aug 02, 2012 7:31 am

I signed a timeshare agreement in June 2, 2012. After that I found out that there was many misrepresentations during the presentation. I am trying get rid of my contract. I found agreement does not meet requirements of Consumer Protection Act, 2002 ONTARIO REGULATION 17/05. which says that The agreement shell set out the information of: Your Rights under the Consumer Protection Act, 2002. Our agreement does not contain such a information. Only information we can find is that Your Rights under the Consumer Protection Act, 2002. are set out in detail in membership carpetta which is only a source of information for new members, not a part of the agreement.
can anyone tell me if I can use this fact to cancel my agreement?

Can I cancel my timeshare agrement?

I think your best bet is talk to an attorney such as Susan Bodowsky. She is an expert in legal matters for timeshares purchased in USA. I am guessing this is where your purchased your timeshare.

If it was purchased in Mexico, my recommendation is to consult with Mexican Timeshare Solutions.

Take action now as some laws defend your rights as a consumer for a limited time.

I think you should consult with a lawyer for this because there are some contracts which we may end with applying some conditions and with the mutual decision of the other party, but in the case of timeshare you must consult it rather going to an unethical or unlawful path.
