I have owned this nightmare of timeshare for over ten years. i have never even used it. I was scammed into buying it with a lot of misrepresentations and empty promises. I have recently searched that timeshare on BBB and found out they had an A+ rating with over 130 complaints. so i made a complaint. i have stated all the misrepresentations and empty promises. i stated i contacted them several times and they blew me off. they got their lawyer involved and this is the response.
The Developer denies any allegations of fraud and misrepresentation and asserts the following response to the allegations listed in the Complaint:
* Investment: No representations were made, verbally or in writing, that the purchase of this timeshare should be considered an "investment" of any kind. The attached Purchaser's Acknowledgement specifically rebuts this statement.
* Buy Back Program: No representations were made, verbally or in writing, that the Developer offers a Buy Back Program. The Developer offers an Equity Transfer Program wherein we agree to take back a currently owned Timeshare in the event the Consumer wants to upgrade.
* Misleading information: The Developer strongly disagrees with the Consumer's allegations that they were misled. The Developer goes to great lengths to make sure that consumers understand the terms of their timeshare ownership. All of the terms, fees and costs associated with the purchase of the timeshare are documented in writing for mutual protection. After signing, each consumer is given a copy of all documents regarding their timeshare purchase.
* Bonus Weeks: The Bonus Weeks program is offered by Resort Condominiums International, (''RCI''). RCI is an entity that is separate and distinct from the Developer. The Consumer needs to address any concerns regarding the usage of their Bonus Weeks with RCI. This information is provided in the attached Purchaser's Acknowledgement.
* Maintenance Fee increase: Maintenance fees and real estate taxes are handled by their management company. The Consumer needs to address any concerns regarding the maintenance fees and real estate taxes to the management company.
* Pressure: The Consumer was not pressured into purchasing. Even after all the documents are drawn, the consumer is under no obligation to purchase. The prospective purchasers always have the option to not sign, not make a down payment and not agree to purchase. Additionally, the attached Purchaser's Acknowledgement specifically rebuts this statement.
The Developer's customers are entitled to rescind their Contract during the legally mandated Ten (10) day rescission period as set forth in the Contract, Public Offering Statement and Receipt for Timeshare Documents. Once the rescission period expires, as it has done in their case, the Contract cannot be rescinded and they cannot simply decide not to be bound by the terms, to which they already agreed.
The Developer has previously investigated and addressed the Owners concerns. The Developer is not willing to cancel the contract at issue in this complaint as there is no evidence of misrepresentation by the Developer, the Contract is paid in full and because the request for cancellation was made well after the rescission period expired.
What should i respond back with? After all i got scammed with, and they still keep just taking my money, I at least don't want them to have an A+ rating on BBB. Any help would be nice
