Can I Claim A Child As A Dependent That I Am Adopting If The Adoption Is Not Yet Final?

she has been with me since birth(she was born on dec 28th). I can't claim her as my daughter but can I still claim her as a dependent. I have her ss# and nobody else does so there won't be any double claiming of this child. I also have a doctors bill for the 30th to show that she was in my care. the tax papers state that if someone lived with me all year that I can claim them to be in my household if they are related to me or not. it also states that a child that was born in the year is considered yours all year.any help in this matter would be greatly appreciated

Claiming your daughter... Yes you can claim her but until the adoption is legel you won't get every credit for her that your allowed when you claiming dependents.   You can claim anyone, sister, brother, parent, neice, nephew, fosterchild that has been placed in your care etc or even a friend but you will get the EIC and the Additional Child Tax Credit for her when the adoption is Final and Legal.   You will also be able to claim adoption fees so keep all receipts of transcations concerning this process.   Hope this helps.     Sources: My experiences Spartan 59 months ago Please sign in to give a compliment. hmmm. I was looking at "qualifying child", rather than "qualifying relative". Under relative, you may in fact be able to claim her, because she passes the household test:http://www.irs.gov/taxtopics/tc354.html"To meet this test, a person must either live with you for the entire year as a member of your household or be related to you. ... If a person was born or died during the year and was a member of your household during the entire part of the year he or she was alive, the person meets the member of household test. "I would say "yes" in this case. But then, I'm not a tax professional.
