Can I sue Home Depot for.....?

We recently bought a pre assembled Spok grill for Home Depot and last night when my dad went to put the steaks on the grill blew up in his face we took him to the ER where they said he has 1st and 2nd Degree burns. Could we sue for Personal Injury?

Home Depot will probably claim that it was a manufacturing defect (i.e. Spok's fault).

Never-the-less, this is certainly the sort of thing the does get sued, and I'm guessing that if you stuck to your guns, Home Depot would probably throw money at you to get you out of their hair.

Beware, unless you can prove that they were negligent or malicious, you're ONLY going to get damages (your Emergency Room bill, perhaps something for your time out of work) in a law suit. You might actually get more money from them trying to shut you up (ain't American law a kick in the pants?).

Did you dad light the grill properly? First degree burns are sunburn, second only slightly worse.

The grill needs to be been assembled improperly, the accident needs to have been their fault.

Wait, he lit it as instructed, or it blew the lid open?

Gas does not explode unless confined, did he press the ligth buttin with the lid closed, or did he turn on the gas and let it run too long?

I do not see how Home Depot did anyhting wrong.

I don't know. Was the accident Home Depot's fault, or your dad's fault?

If there were any instructions that your dad failed to follow, or if your dad did something wrong to cause the accident, then he cannot sue Home Depot or anyone else for his injuries.

Yes thats a pretty major injury. You could probably sue them for not 1,000,000 probably a little bit under. Tell your dad i hope he feels better!
