Chapter 7 Bankruptcy or SOL 4 Years Texas?

Postby devon » Wed Jul 25, 2012 7:05 am

I am considering going either sol 4 years in texas route or chapter 7 for my credit card debt and my deceased wife's medical bills/credit cards. She passed away 6 months ago with no estate or will, insolvent. The debt is almost 100k, with each being 50/50.

All my assets are exempt under state law, house, 1 car, except my business inventory which would be around 5k only.

If I stop paying bills or chapter 7, I am screwed either way with my credit and merchant account. What most scares me is how chapter 7 dissolves your home loan, and in reality the bank can call it due or foreclose for almost any reason.

I am current on all my bills except my wife's which I stopped paying after she pasted away. I somehow feel safer with the SOL route as the home loan will not be a issue (although i owe 30k in credit card debt to the same company that owns the home note).

I figure I would try the SOL route first, if lawsuits actually come up, I can always go the bankruptcy way then.

Anyone with experience with this situation, dealing with business inventory in chapter 7, and dealing with merchant accounts/paypal?

Thanks in advance!
