Consumer Law- What recourse do customers have when a store will not honor stated return policy?

Postby elkan80 » Mon Dec 19, 2011 11:57 am

Would appreciate the legal angle on this- if a store publishes their return policy in the following places: 1. their online store website 2. their physical store @ the register 3. printed on bottom of receipt- are they not required by consumer protection laws to honor their stated policy? If they refuse to honor their policy, or change their policy without posting it, updating their website, or printing the new policy on receipts, what legal recourse does the consumer have?

there is no law in the US that says you are entitled to return anything just company policy, given that they can change or make any conditions on their policy they like, you are free to take them to court if you like or no longer shop there

If it is on the receipt that is going to be binding. You can take them to small claims court or civil court if there is some reason small claims court doesn't have jurisdiction and probably win. With the other two ways it will be part of the burden of proof that you based your buying decision on the published policy. The problem will be if there is a change in the policy proving when the change was made.

Under Torts, you may sue for false advertisement and bait and switch business practices. Depending the breadth and weight of the case may determine whether or not a lawyer would take your case. If you are talking 10 bucks or something minimal like that, I doubt it.
