Do I've A Medical Malpractice Case?

Postby ellsworth6 » Fri May 02, 2014 9:34 am

In August of 09 I had been applying my table found at my home and that I reduce my index and middle-finger down in the 2nd knuckle. I visited the ER and so they life flighted me right down to USC SanDeigo where the Physician reattatched my fingertips. 5 Times later I had been launched and sent home that will be 3 hours from where my hands got reattached at. I attempted to get involved with physical therepy around wherever I lived But without Insurance no body might help me.When I had been in a position to obtain a trip to determine the physician I told him that it had been very difficult for me personally to obtain completely right down to his workplace and when he can recomend a health care provider which was sooner, he explained there wasnt any of course if I'd any problems to go-to nearby Hospitial. About 3 months once they got my bandages off i reinjured my palm I visited the neighborhood clinic and so they explained they didnt have anyone who may help me which i had a need to drop and find out my physician. It had been about 2.5 weeks before I may find another trip right down to him and durning that point Our middle-finger that was kept on by hooks slid and that I got a bone disease inside the damage.
At this time And each time I noticed the physician before this time around I asked him why he reattatched them since he did a superb work I'd sensation within the guidelines of these equally but I took the muscles in my own index finger so today it doesnt bend at-all and also the method he fixxed the center hand it doesnt correct out. Which in turn causes not just a lot of discomfort but my middle-finger gets caught on issues after I take anything and-or the index finger strikes, pokes, bends sideways since it doesnt bend,. Of course if he'd of simply left them off 1 I possibly could create a fist, 2, I wouldnt have needed to withstand all the discomfort that ive suffered, 3 right now I'd have complete utilization of that palm. By him reattatching them offered me a chance to get contamination like I've and today we mentioned following a year of discomfort eliminating one or even the additional  or both. Although not in the next knuckle like i origionally made it happen but in the arm of course if he eliminates them both he discussed losing my flash right down to where my middle-finger has become and slicing away all the hand bulk that's linked to the list and middle-finger. And so I may have 3 hands similarly.
I do not understand what todo? there isnt a hand expert around wherever I reside and that I was informed when he cuts them down since he's the one which hook them up to it wouldnt be mal-practice. I reside in Morongo Valley Ca the only real other-hand expert is in San fransisco. I've no method to make it happen and that I dont understand how long I've to document suit.I was never questioned what I believed since I'd of said keep them down in the 2nd knuckle I'll not just shed one or both of my fingertips today but section of my hand additionally. What resourses do I've Open To me And Just How long to I've to Document this situation, how do you obtain a second opinion since there isnt any palm expert around below Please support I dont wish to proceed under his blade again since he didnt asked me my oppinion the very first time Im affraid I'll awaken with no hand this time around. Thanks for the period. I've no difficulties delivering pictures or the paperwork I've in the physician to ensure that somebody may reply me. again thanks for the occasion in this issue. Daniel

Do I Have A Medical Malpractice Case?

Postby Comhghall » Tue May 06, 2014 6:47 pm

Although it's painful, I would give it some more time unless the dr says there is a chance of gangrene setting in, which can spread.

You may be able to do some physical therapy at home...if the dr can't give you some instructions, perhaps you can find some on the internet.

Do I Have A Medical Malpractice Case?

If your subsequent medical problems were the result of your delay in seeking follow-up medical care that's likely to be on you, not the doctors.

Even if you do live in a rural area with few doctors, that's likely not going to be enough for a malpractice finding. The responsibility of the doctors was to tell you what you needed to do and when to do it. It was not their responsibiity, however, to solve your transportation problems.

Do I Have A Medical Malpractice Case?

I don't see where there has been any malpractice.

You injured yourself and the hospital life flighted you to the specialist who could handle the injury.  You KNEW at that time that they were sending you a great distance and you had no insurance.  You had the option then of declining transfer and re-attachment surgery.

When the surgery was done you lacked insurance or finances for the after care physical therapy and didn't do it. So the fingers were then re-injured.  You waited 2.5 months to return to your surgeon as advised by local physicians and subsequently got another complication due to the re-injury.

What negligence has the surgeon committed by performing a surgery that you consented to?  How is he negligent because you could not afford the after care and re-injured yourself?

You can consult a med/mal attorney or two but without expert medical testimony that the cause of your current issues is negligence or malpractice there is no case.

Do I Have A Medical Malpractice Case?

Could the problem be that you re-injured the hand and -though it wasn't your fault- you waited 2 1/2 months to see the dr again, rather than anything the dr did wrong?  Is the infection gone now?  If so, it still may take awhile for your hand to recover from all the trauma.

You can contact a med malpractice attorney to see if he/she sees any liability here.  There is not usually a fee, but sounds like there may not be many where you live.  Be sure to call rather than email with a quick synopsis of your experience.

The fact that you reinjured the hand and waited 2-1/2 months following that to see the doctor would be extremely detrimental in pursuing malpractice - particularly since you got an infection at the time and it is certainly not the doctor's fault  you had delays due to lack of transportation.

No one on a board can state malpractice occurred--you would have to consult a local medmal attorney. Nor can anyone tell you how to obtain a second opinion lacking transportation.   In this regard, you should contact California's Dept. of Health Care Services.

It appears that the doctor didn't ask your opinion the first time around because it was clearly an emergency situation and I am sure the hospital had you sign consent forms at the time.

From your post, it seems like he did the first procedure without complications uintil you reinjured the hand.
