It depends. If you are a 1099, but work in the same building or place everyday, then the employer needs to cover you for workers comp.If you are a 1099 but work in different locations - like a cleaning crew that goes to various sites to work, then the employer is not required to cover you. Getting hurt on a remote job site - like an office you are cleaning means you the location office should have insurance coverage for you, in the event you are hurt.Getting paid by the hour has nothing to do with workers comp claims.Also:If the employer informes you he does and will not carry this type of insurace, and you agree and sign off and are compensated for said lack of coverage, then your "employer" need not carry Workmans Comp Insurance on you.If you want complete details of who and what coverages need to be carried go to Google.com and search Workmans Comp rules & regulations for your state as all states vary a small amount.
