Greetings!! I have many questions concerning my HOA and board members rights to change bylaws. I have searched and searched and haven't been able to find anything regarding the HOA and Texas laws. We've been having problems with our board trying to pass new bylaws without holding meetings, and they've also changed how many people you need to have in order to make a quorum. (without voting upon it) I really would like to know what Texas HOA law states to make sure that the board is not changing things illegally. I know previously we used to have 40% to make a quorum, they changed it(without voting) to 20% and want to make 10%. Can they do that without voting on it?? Anything you can let me know about the Texas HOA laws, or how my HOA can act legally would be so much appreciated!! Thank you so much for you time!! Have a great day!!
ANSWER: You need to look at the previous bylaws and find out if the amendment of the bylaws was done properly. If not, you as a member of the HOA would be able to sue in court.
