How do I handle a complaint for monies due while filing chapter 7 bankruptcy?

Discover card served me with summons via a law service/collection agency. This was four months ago and I've heard nothing since, so I guess I was found guilty. Now I'm filing for bankruptcy under chapter 7 and don't know if this is a secured or unsecured debt.

You need a lawyer, my dear. Going through bankruptcy without one is a huge mistake and your case may even be thrown out.

Bankruptcy lawyers are used to seeing clients who are, well, bankrupt. More often than not, their clients have no money. They are used to dealing with this. Many of them are willing to be creative and just about all of them will meet with you initially for free. You can't afford not to have a lawyer for something this serious.

Your lawyer will get creditors off your back immediately, including Discover Card.

You hand it to the attorney you can't afford NOT to have handling your bankruptcy. ATTEMPTING to get though bankruptcy WITHOUT an attorney was NEVER in the question. You WILL end up WORSE off than if you never filed

The ONLY way ANYONE can spend enough time to cover HALF of what you NEED to know is if you actually HIRE AN ATTORNEY.

You should have a bankruptcy lawyer because of this type of thing. If you don't, making mistakes in your filing could result in not being protected from all creditors.

I think you should contact the lawyer who you are filing bankruptcy with and they will advise you.

Contact your lawyer and have them add the discovery card debt. Problem solved.
