Is it too.late to sue for malpractice?

About 4 years ago I gave birth to my daughter and afterwards had to have reconstructed surgery plus a very rare surgery due to my doctors negligence. At the time they hospital lawyers time us that the surgery I had was very common and that no lawyer or firm would take our case. Well, I'm pregnant with my second child and my new doctor read the records and is outraged because my surgery could've been been prevented and I most definitely would've had a case. But since its been 4 years I'm being good that its too late. Is this true?

'Statutes of Limitations' (laws saying how long you can sue) vary from US state to US state. The medical profession, doctors, and insurance companies are usually the best protected by laws written in their favor with the shortest sue time periods.
However, 4 years may not be too late!...To find out, you can go to www.google.com...put in this search term....'compiled laws (your state's name)' , finding the website look for... 'medical malpractice statute of limitations' and see what it is.
If this does not work or it can't be found, then look in your 'Yellow Pages' Yellow Book' for your area, under 'attorneys' (there will be a zillion of them) pick a big ad that says 'Medical Malpractice' (because your only going to ask a question). Phone them 9-5 during the business week....say.. 'you have a medical malpractice case but you think the statute of limitations may have run'....You should be turned over to an attorney who can tell you right away. If not, thank them, and call the next biggest medical malpractice attorney ad.
It should be an easy answer but it depends on your states law and the circumstances.
