Need help with a racing ticket on a motorcycle (please)?

Postby madison86 » Tue Apr 24, 2012 3:46 pm

I got a Ticket for racing my motorcycle , and when I was pulled over he told me he did not clock me and I did not receive a speeding ticket the posted speed limit was 35 mph I hardly believe that I could have been racing without exceeding 35 mph, I was not racing at all me and my friend were just out having a good time, he also gave me a ticket for not keeping both wheels on the ground I just got my bike and im still learning it only has 1000 miles on it and my wheel did leave the ground but it was not purposely i was beachside and there was sand over the spot where i was stopped and my tire spun then cought the road n lifted a few inches but the law states it is not illegal if my wheel leaves the ground briefly because of weather or road conditions, he does not have me on dash cam nor clocked on radar. Do I have a good chance of beating the tickets with a layer?

You will have to go to court to fight the ticket without pleading guilty. You can plead guilty to the wheelie and explain and possibly get it dismised but if your not guilty of racing then dont plead guilty *unless your lawyer atorney what ever says yes.*

Never plead guilty.

What exactly were you cited or charged with?

Unsafe start? Reckless driving?

There should be a statute or code number of the violation you were cited or charged with. Look up the exact code and read what the law actually says.

Most "unsafe starts" refer to "merging" into traffic.

Most reckless driving code cover passing, going too fast, going too slow or refusing to let someone pass.

See if the code mentions spinning the rear tire "burn out" or "wheeling". I can almost guarantee it does not.

Feel free to email me.

If the ticket was not for speeding what was it for? It is against the law if both wheels are not on the ground in most places; in Australia it is called 'dangerous riding'. You would have to pay the fine or plead not guilty in a court; but if you are honestly guilty then pay the fine, a lawyer isn't cheap and you really need a lawyer.

A defense is not that you are not an experienced rider enough to control the bike; but that may be the case as you say it is a cbr600rr and you are 'still learning'..

He did not clock you.

He did not give a ticket.

You are free to go.
