What are my chances of getting my DUI reduced to reckless driving or dismissed?

I was recently charged with a DUI to the slightest degree in Arizona. I have hired an experienced attorney to defend my case. I have never had any kind of record in the past civil or criminal traffic. I am a responsible citizen and I go to school in Illinois.

My BAC blood test came out to be 0.09 just slightly above 0.08 legal limit.

What are my chances of getting my charges reduced to reckless driving or dismissed or reduced to anything other than DUI?

If your attorney is a good one, I think your chances are pretty good. Your past record (or lack thereof) and conduct, and the barely over the limit reading will work in your favor so you probably have a good chance. I don't see a dismissal, but certainly a reduced charge. The attorney will probably work with the prosecutor to work out a deal like this before it ever goes to court.

What does your lawyer say? You are paying him. He would be your best source of info.

Laws vary from state to state. It use to be that lawyers could play games with the courts (changing jurisictions, rescheduling court dates,etc) until the case kinda disappeared. That tends to not be the case any more. Most states have strict punishments for DUI. First offense probably won't get you jail time, but anticipate spending lots of money -- fines, DUI school, rehab programs, probation fees, etc.

Whatever happens with this DUI, just make sure it is the LAST one you ever get. If you drink, just don't drive. Second offenses often include jail time.

This depends 100% on your county and the prosecutor assigned to your case.

If your attorney has a good relationship with the prosecutor, you have a better chance at a deal. If the prosecutor hates your attorney, you're not likely to receive a good offer and will probably have to take it to trial.

You are in denial. A "responsible citizen" does not drink and drive. Ever. Or hire an expensive lawyer hoping to make the charges go away.
