I ruptured my biceps tendon on the job and had to have surgery to repair it. When i reported it to my employer the first thing she asked was if I had been to the gym recently. She told the workers comp insurance that she has concerns because i go to the gym. workers comp is now doing a full investigation. I hadn't been to the gym in over a month and i did send a copy of my gym records to prove that. When i returned to work after my surgery i received three write ups for things that happened before my injury.(this company doesn't ever give write ups out)One of the incidents was something that happened 6 months ago. she also put on one of them that i was being dismissed. When i questioned it she said they were just trying to scare me.  She has also been making comments about somebody getting fired in the next six months to co workers. Can I be fired? Could this be considered retaliation? I live in Utah

Sorry for the delay in answering first off. According to the law the company can do almost anything, there is no law saying they can not terminate you or write you up for being injured on the Job. I would however file a complaint with the labor department for harassment. As for the investigation the workers compensation has the right to investigate your case at will. But no matter if you were injured at the gym, if you further injured your self at work later you are still covered. There is no clause for them to deny a claim due to further injury. Again sorry for the delay and hope this helps.
