Can i kick my ex girlfriend out of my apartment?

There was a girl living downstairs and i lived right above her, she lived with one of my friends as a roommate. When i met her we started getting along, one day she got really drunk and claims she got "raped" by her roommate, which i don't buy for a second, well we started dating within the next few days. She kept telling me how it was so awkward living with him. So one night i was just in a good mood and i was like "well why don't you just come up here and live with me and my roommate" so then she said "I'm so glad you asked I've been hinting at it all day long". Then we were talking about how she was going to pay a little rent and worked out a few details. Well we broke up a week after that because of many reasons and she has cats and i can't live with cats. Well the night i broke up with her she tried to kill herself by overdosing because she has nowhere else to go, no friends, no family, no job, no car or a phone, she has nothing. Well now, she's out of the hospital and out of the psyche ward and i want her out but she refuses to go. She's not on the lease, she doesn't receive any mail here. saying i need to get a court order and i can't just put her stuff out and all that. I live in arizona and I've tried looking for the laws but i have multiple telling me many different things that are legal and not and I'm confused, she's not on the lease, she's only lived here for 2 and a half weeks, she's not gonna pay rent because she has no job, which we agreed she would, but she has no job so she has no money. What do i do? Can i just kick her out even though she's been here for almost 3 weeks?

yes just kick her out. or call the cops on her. get rid of her asap. just dont let her know your doing it because she sounds crazy

There are a couple ways to go about this. If she is as difficult as you say, law enforcement may be your only avenue of approach.

I will describe the most "humane" and legal process at your disposal. I will assume that at one point you had an agreement for rent which she has now defaulted on.

Go to the court which has jurisdiction over where you live. If you go to the clerk of courts, you will be able to receive an eviction complaint form. Once you file the "forcible entry and detainer" lawsuit - the court will appoint a sheriff or constable to serve your tenant and a hearing date will be set, (usually 3-6 working days from your filing date). Once the judge makes a ruling, he will usually allow her 5 days to vacate the residence. Now,

If she fails to vacate the residence within this time, for any reason, you will be able to request from the court a writ of restitution and the sheriff's dept that serves the court will forcibly remove her from the residence. Should she return at any point for any reason, she will be considered trespassing which of course is a criminal offense.

Hope this help! I do not envy your situation, these can be tough. Hopefully you don't have to go through all the above steps just to get her to move out.
