Can you sue for slander on Facebook?

My husbands ex (they have a child together) is constantly talking about us on her Facebook. She says that he never does anything for the baby (even though he does), she has even said that I gave him herpes and that's why he's with me (not true). I am just so sick of people telling me all the bad things she saying. I blocked her and I don't talk about her anytime. She's called my son a bastard and told everyone that my baby is not my husbands. I don't really want to sue her, I just want her to stop being so damn immature. Any suggestions?

Sure you can sue, you can sue anyone for anything. The trick is can you win... you have nothing to win.

Sure, you can sue. I'd assume you actually want to know if you'll win. That, you won't. You probably don't have financial losses or a major loss to your reputation to recoup. You'd also have to prove she knows those things are false and is intentionally and maliciously spreading the rumor. It's very hard to prove a person's thought process. My suggestion is to ignore her. If she knows she's getting a razz out of you, she will continue. If she doesn't get any responses out of you, she will likely stop.

As others have said, I'm afraid you don't have a real case for suing.

I don't know if this might help, but I've been hearing a lot about a company that helps clean up negative comments about you online. It's Reputation.com. Whether they can help in your case, I don't know, but according to their website the initial consultation is free. Lies are not any basis to sue for. You would have to prove you were "damaged" somehow. Usually the "damage" is something along the lines of earning capacity (like she damaged your reputation so bad that nobody will hire you, or do business with you, etc)

Well first off slander is a criminal offense, not something you sue over. Though technically you CAN sue anyone for any reason. But you need to look up the definition of slander. In my experience most people have absolutely no clue what actually constitutes slander. Just telling lies about somebody or talking "smack" about them is not slander. It has to be something that would cause them damages. Usually it applies to public people such as politicians. Damages would be keeping someone from being elected or hired to a job because of lies you told about them or something like that. One part of slander that MIGHT could be construed to apply here is "Charging a person with having some contagious disorder or with being guilty of some debasing act which may exclude him from society". If she's saying you have herpes that's a contagious disorder. However, you would have to prove beyond a shadow of a doubt how this caused you to be "excluded from society". I would imagine that you have not been.
