DVR after not guilty judgment

I am a commercial driver and April 2011 I was forced off the road by an on coming vehicle when he crossed the center line, we never collided and he never stopped. I was ticketed with "failure to maintain control" which I pleaded not guilty to and was ruled by the judge as not guilty, however my company charged me with the accident. In my employee file they stated I didn't allow myself an "out" since I admitted to driving 8 mph over the speed limit. I am wanting to apply for new employment and on the applications for DOT regulated drivers it asks for all accidents at fault or not at fault. Do I have to list this accident on the applications if it was judged not guilty? If I say no and since TN is a right to work state will my employer tell them any accidents on my employee file?
