I have the right to refund my money. right?

I have bought a cellphone just recently and it was a reconditioned phone..it has a warranty of 3 mos but i really want to refund my money already..i have been going back to that store for 3x and still they can't give me a decently working phone! ooh i really am pissed off with them! i want my money to be refunded but they are saying that they do not refund..why can't they just refund my money since they really can't give a decently working phone..i am really really angry with them..their store should be closed! they are fooling people..

What were the terms and condition when you purchased that second hand phone, Have you got the Bill and what are the terms in the Bill they issued you with the phone. If replacement term is there they will have to change the phone and If they say if the phone is not working they will refund then only they will refund. I think you can ask them to replace your phone with some other which works.

they do not have a registered official receipt which has terms and conditions so i will be insisting on a refund since i have changed the unit 3x already and still they cannot provide a better one so i will be definitely asking for a refund.

The same thing happened to me few months ago. Sad to say they just won't offer u a refund. The moment that the reconditioned phone is sold to you, it means you agreed to their terms and conditions. The best you can do right now is save few hundreds then choose a brand new phone as a replacement. I got a defective Nokia 1100. Defective in a sense that it's not openline and it can't be converted. I took me few days to come up with few bucks then they replaced it with a brand new 1200. I'm still using it now and this time it comes with an official warranty from Nokia.

i did that already i have added a few hundreds for an 3100 phone..since the store doesn't have any brand new phones it gave me no choice..i still had a reconditioned phone and i am now really not satisfied with the phone..i really want to refund my money and i will insist on doing so..

i am sorry to hear about that . you are so unlucky.if you know the consumer support line number,i suggest you call them and get back your money.it's better than waste time with the unhonest seller.

i personally went to the store and they had replaced the phone that i have purchased with them but it is still not working very good..when we are in the store checking for the phone there are no problems but once we arrived in our home i will find another problem..i will really refund my money and i will insist on it.

It all depends on the terms that you bought the phone. If the store's policy is "no refunds" then we should be careful on what we buy with them. I hope you have proof of warranty, then you can inspect that and find a loophole to probably force them to give you a refund - something like them promising to fix your phone, but if they can't then that's their problem and you can sue them for that.

there is nothing stated on their store that they do not do refunds but the sales lady is saying that they will do no refunds..but i will not accept that verbal warning..i will be really insisting on a refund..

If you have official receipts to prove you bought the celphone in that particular shop, you can file a complaint at the Department of Trade and Industry. Commercial establishments in the Philippines are no longer allowed to impose a "No Return, No Exchange" policy. I forgot the specific law, but a Consumer Act was enacted into law during the Ramos Administration. Any seller in the Philippines is required by law to honor its warranty and/or to replace/refund any defective product that they have sold to a consumer.
