Lazy boy refusing to refund me what else can I do?

Postby caomh » Sun Nov 20, 2011 12:12 am

After placing a special order for a couch I came home and remeasured the area. Upon comparing the measurements to that of the couch I realized that the couch would not be able to fit. Since I noted the statement at the bottom of my receipt stating there are no refunds on special orders I called the next day to cancel the order at which time I spoke to the gentlemen that sold me the couch. After explaining to him the measurements and my suspicions the couch would be unable to fit down the hall he guaranteed the movers would be able to make it fit and guaranteed a full refund if the couch was unable to fit. After receiving the couch and it not fitting in the desired area I called to get my card refunded at which point I was refused despite his guarantee. I will also be calling my bank to attempt to file a fraud dispute due to this transaction. And have filed a dispute with the BBB, is there anything else I can do at least to warn other consumers about their bad business practices.

You got shafted. His so-called guarantee wasn't worth the paper it was written on. Of course since there are no refunds on special orders you had no chance of getting a refund anyways, but no fraud or BBB dispute will make any difference due to the terms of sale being explicit.

Besides, you've got no proof he offered you a money-back guarantee. Your word against his. If anyone could get a refund by filing a claim without proof, it'd be a bad place for business indeed. If you're VERY lucky other people will have filed similar complaints and the preponderance of evidence will swing in your favor... but that's the only way a third party will rule in your favor.
