I have yet to see an attorney admit their client was at fault Most likely he or she would get disbarred for doing so. The simple reason why these kinds of cases get dragged out for years is because the company doesn't want to pay and they're hoping that by dragging it out the problem may just go away because the plaintiff will not continue to pursue it. That's the real world reason why it happens. As to why it's allowed to happen, it's because the system allows it. There are two parties in every dispute and each party has the right to protect its interests and present a complete case. In these situations, it can be really unfair to the little guy who was hurt, but larger companies have the money to wait them out and to use attorneys who know how to work the system.Of course, there have been many instances in which people have filed false claims, and that has ultimately helped create precedent that can favor a company. But the bottom line is that it all comes down to who has the better attorneys, and in most cases that will not be the person who was injured.
